1. Definitions

Services: professional translation services, including certified and sworn translation where applicable, interpretation and corporate linguistic support offered by Obůrkova Legal & Linguistic Services.
Client: any individual or legal entity requesting or engaging the Services.
Website: the website www.oburkova.com and its sections.
Email: info@oburkova.com.
WhatsApp: the number published on the Website for Client service.
Certified / sworn translation: a translation issued with the certification elements applicable to the contracted service and the relevant legal or institutional requirements.
Quotation: a written document describing the scope, fees, applicable taxes, delivery times and payment terms.

2. Scope of Service

The Services are provided based on the information and documents supplied by the Client. For proper performance, the Client agrees to provide complete, legible, truthful and timely information, and to answer contextual questions whenever necessary.

Exact Scope = Written Quotation

The final scope, including source and target language, number of pages, delivery format, certification, urgency and other relevant conditions, shall be defined in the Quotation accepted by the Client.

3. Place of Performance

The service is provided from Santiago de Queretaro, Queretaro, Mexico. Depending on the project, the Services may be provided remotely and/or in person, including on-site interpretation, in accordance with the accepted Quotation and the agreed schedule.

4. Confidentiality

All information and documentation provided by the Client shall be treated with strict confidentiality. It shall not be disclosed or shared with third parties, except when strictly necessary for the provision of the service, such as printing, courier services or technical support, or when required by a competent authority.

The Client also agrees to keep confidential any sensitive commercial information or methodologies that may be shared with the Client.

5. Statement on Authenticity of Documents

The Client represents that the documents submitted for translation or interpretation are authentic and have not been altered, modified or falsified. The Client acknowledges awareness of the applicable legal consequences arising from forgery or the use of non-authentic documents.

Obůrkova Legal & Linguistic Services reserves the right to refuse service when there are reasonable doubts regarding the authenticity of the material provided.

6. Rights and Intellectual Property

The Client represents and warrants that they have the necessary rights to provide the documents for translation or interpretation, and that such documents do not infringe copyright, intellectual property, privacy or any other third-party rights. The Client assumes responsibility for any claims arising from the content provided and releases Obůrkova Legal & Linguistic Services from liability in this regard.

7. Quotation and Document Review

To issue a Quotation, the Client must share the document or documents to be translated, or the details of the interpretation service, through the Website form, email or WhatsApp.

Prices may vary depending on the type of document, complexity, legibility or quality, number of pages or words, terminology, required certification and urgency.
Every Quotation is issued in writing and constitutes the only binding basis for the service.
Prices communicated verbally or through unofficial messages are for information purposes only and are not binding.

8. Currency, Payment Methods and Confirmation

Unless otherwise agreed in writing, quotations are expressed in Mexican pesos (MXN). Payment methods shall be indicated in the Quotation, for example, bank transfer, deposit or available electronic payment methods.

To start the service, the Client must send proof of payment through the indicated channel. The service is scheduled and processed once payment is confirmed.

9. Taxes and Billing

To request an invoice, the Client must provide the required tax information and documentation, such as a valid Mexican tax status certificate where applicable, within the month in which payment was made or in accordance with the policy stated in the Quotation.

10. Format, Certification and Variations

Obůrkova Legal & Linguistic Services endeavors to preserve the format of the original document as faithfully as possible. However, the Client acknowledges that certain elements may vary for technical reasons, including legibility, tables, seals, signatures, margins and available fonts.

Certified or sworn translations shall include, as applicable, certification language, contact information, place and date of issuance, signature or signatures, and any other elements required for the contracted service.

11. Replacement of Files After the Service Has Started

Once the service has started, it is not possible to replace the file with another version without prior review. If the Client submits a different version, even if it is considered the “same” document with better quality, adjustments to costs, delivery times or a new Quotation may be required.

12. Delivery Methods, Courier Service and Verification

As a general rule, the Client receives a digital version in PDF format. When the service includes physical delivery, the Client may:

pick up the documents at the agreed location, where applicable; or
request delivery by courier or messenger service, domestic or international, which may be provided by a third party.

The Client is responsible for verifying the format required by the receiving authority or institution, including original or copy, physical or digital format, apostilles and any other applicable requirements.

Courier Service

Once the tracking number has been provided, shipment tracking is managed directly with the courier company. Any incident, including delays, loss or damage, must be handled in accordance with the courier company’s policies.

13. Retention and Storage

For quality control, reprints and corrections, files and digital deliverables may be retained for a limited period. As a reference:

digital deliverables: up to 30 calendar days after delivery, unless otherwise agreed;
physical deliverables, where applicable: up to 1 year from the date of delivery or availability.

The Client acknowledges that they are responsible for downloading and backing up the digital versions delivered.

14. Cancellation and Refunds

Once the order has been confirmed and/or the service has started, cancellation or refund shall not be available, since the work is performed on a customized basis and within committed timeframes.

15. Period for Requesting Corrections

Any correction request must be submitted within 30 calendar days from delivery. Corrections are limited to material translation, formatting or typing errors, and do not include changes arising from substituted documents or new information not originally provided.

16. Warranty

Obůrkova Legal & Linguistic Services warrants that the Services are performed with professional rigor and in accordance with the scope agreed in the Quotation. The Client acknowledges that they are responsible for verifying whether the translation or interpretation is suitable for the specific procedure and the particular criteria of the receiving authority.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Obůrkova Legal & Linguistic Services shall not be liable for indirect, incidental, punitive or consequential damages, loss of profits, data or intangible assets.

If liability is determined, it shall not exceed, under any circumstance, the amount effectively paid by the Client for the specific service giving rise to the claim.

18. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by the laws of Mexico. Any dispute arising from the use of the Website or the Services shall be submitted to the competent courts of Queretaro, Mexico, unless otherwise required by applicable mandatory law.

19. Acceptance and Privacy Policy

By browsing the Website, submitting documents through a form, email or WhatsApp, and/or engaging the Services, the Client accepts these Terms and Conditions and consents to the processing of personal data in accordance with the Privacy Policy. If the Client does not agree, they must refrain from using the Website and/or engaging the Services.

20. Modifications

Obůrkova Legal & Linguistic Services reserves the right to modify these Terms and Conditions at any time. Changes shall be published on this page, indicating the date of the last update. Continued use of the Website or the Services after changes become effective constitutes acceptance thereof.
